Do we own the prototype code?

Yes. Clients own the deliverables Nisco AI Systems produces, including prototype code and documentation. A prototype that cannot be carried forward into production defeats the purpose of building one.

What happens if the proof of concept fails?

A proof of concept that shows a use case will not work is a successful engagement. Nisco AI Systems reports the result honestly, explains the technical reason, and where possible identifies an adjacent use case more likely to succeed. Finding out in weeks is considerably cheaper than finding out after a full build.
